The use of the service is reserved for consumers over 18 years of age or who are authorised by their legal representative and whose purpose is individual and in no case commercial or professional.

The resale or rental of products purchased on this site is strictly prohibited, as well as their commercial or professional use of any kind.

Pescaviar SL reserves the right to modify these terms and conditions of sale at any time and without prior notice. The customer is obliged to accept only the terms in force at the time of purchase.

Each product is represented by several images as well as a description, faithful to the reality of the product. The variations due to the characteristics or resolution of the user’s or client’s device are not the responsibility of Pescaviar SL.

Once the purchase has been confirmed, the order will be sent by the contracted transport agency.

Once the purchase has been made, the customer can request changes to the order as long as it has not been processed and is on its way. To do so, the customer must contact Pescaviar, indicating the references provided.

Pescaviar SL reserves the right to refuse the order of any customer who has previously failed to comply with the conditions of purchase.

The purchase procedure will be considered complete when the customer confirms the purchase, and Pescaviar SL has accepted the management in its entirety.

Stock is limited. The website will display the products available at that time.

In the event of a problem with the stock of an ordered product, Pescaviar SL will inform the customer as soon as possible.

The contract of purchase between Pescaviar SL and the client will be complete after the verification of the availability of the stock of the product, of the charge in the credit card of the corresponding amount, and after the client receives the confirmation of the order on the part of Pescaviar SL.

Prices include legally applicable taxes (VAT) and are shown in Euros (EUR).

Pescaviar SL reserves the right to change the prices of the articles promoted on its website at any time and without prior notice. The customer shall pay the price stated at the time of order confirmation.

The shipment of the order will take place once Pescaviar SL has verified the bank details provided by the buyer and receives reliable authorisation to charge the purchase.

This merchant undertakes not to allow any transaction that is illegal, or is deemed by credit card brands or the acquiring bank, that may or has the potential to damage their goodwill or negatively influence them. The following activities are prohibited under the card brand programmes: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Purchaser, Issuing Bank, Merchant, Cardholder, or cards. In addition, the following activities are also explicitly prohibited:

  • “Sale of alcoholic beverages to persons under 18 years of age”.

Orders for delivery outside the European Union may incur an extra cost due to customs or import charges. These costs shall be at the expense and responsibility of the purchaser and shall be settled where and as designated by the competent authority. Pescaviar SL has no responsibility for them.

Delivery times are approximate, Pescaviar SL offers the following estimates:

  • Peninsula:
    • Orders placed from Monday to Wednesday before 17:00h will be delivered within 48h.
    • Orders placed on Thursday and Friday before 17h will be delivered on Tuesday of the following week before 13h30, this way we can ensure that the cold chain is not broken.
  • Baleares:
    • Orders placed from Monday to Wednesday before 17:00h will be delivered within 72h.
    • Orders placed on Thursday and Friday before 17h will be delivered on Wednesday of the following week before 13h30, this way we can ensure that the cold chain is not broken.

The shipping costs are described during the purchase process, before the order confirmation, depending on the volume and destination.

No deliveries are made on Saturdays, Sundays or public holidays in the Spanish calendar and in the provinces of Madrid and Murcia.

In case of loss of the product due to causes attributable to the transport company, Pescaviar SL will resend it at no cost to the buyer, once the fact has been investigated.

When making a purchase, the customer accepts the commitment to sign the reception sheet presented upon delivery of the order, in which he/she may include any observations he/she deems appropriate, always leaving a record of the state in which he/she receives his/her purchase. The customer acknowledges having received the order as requested, clarifying the state in which it has been delivered.

If you wish to report an incident, you must state the details of the incident on the delivery document and make a complaint within a maximum period of 24 hours.

Shipping costs resulting from an unjustified exchange shall be borne by the purchaser.

To make an exchange the customer must contact Pescaviar SL communicating their intention to exchange the product for another within a period not exceeding 15 days from receipt of the same.

In case the return generates a difference in the amount of the purchase in favour of Pescaviar SL the customer will pay the difference.

In the event that the return generates a difference in favour of the customer, Pescaviar SL will reimburse the customer this amount in the same form of payment in which the order was made.

The customer has the right to withdraw from the contract within 14 days of receipt of the order. If the customer cancels the purchase contract, the customer shall bear the cost of returning the order. The customer will be reimbursed for all payments, including delivery costs within 14 days after Pescaviar SL has been informed of your decision. Such refunds will be made using the same payment method used by the customer for the purchase.

In the case of the return of a product belonging to a multiple order, the delivery costs will not be refunded.

Products must be returned in perfect condition and in their original packaging. No returns or exchanges will be accepted if items are returned incomplete, damaged or opened.

Return costs, customs and local taxes are the responsibility of the customer. If the return costs are higher than the value of the goods to be returned, you will be charged the remaining balance.

Pescaviar SL guarantees the authenticity and high quality of its products.

It is totally forbidden to copy or reproduce in whole or in part any content, whether textual and/or graphic, present on the Pescaviar Sl website without its prior and express consent.

Pescaviar SL. reserves the right to modify or cancel, temporarily or permanently, the service or any part thereof, with or without notice. Pescaviar SL shall not be liable to the customer or to third parties for such modification or cancellation.

The order is subject to the Terms and Conditions in force at the date and time the customer places the order.

The purchase contract between the customer and Pescaviar SL is governed by Spanish law.

SEVENTH – ELIGIBILITY REQUIREMENTS

Participation is open to all natural persons who meet the conditions set out in these rules.

All residents of Spain (except Ceuta, Melilla and the Canary Islands) of any age, previously registered on Instagram with a single real user and who follow Spherika, can participate in the draw free of charge and voluntarily. They must actively participate in the draw according to the mechanics set out in this document.

In relation to the participation of minors, the Organiser informs that parents and guardians are solely responsible for monitoring and assisting minors in the mechanics of the sweepstakes and browsing their social networks.

Any content that the Organiser considers unsuitable, inappropriate, offensive, violent, sexist, racist, or that violates the fundamental rights of individuals will be excluded from the prize draw.

All employees of Pescaviar S.L., as well as their direct relatives (spouses, parents, siblings or children), as well as any person professionally related to this prize draw are expressly excluded from participating in this prize draw, and their participation will be cancelled as soon as this condition of employee, direct relative or person professionally related to the promotion is detected.

TENTH – PRIZE SUBMISSION REQUIREMENTS

In order to receive the prize won in the draw, the winner will have to send, within a maximum period of 10 days from the publication of the winner, a private message via Instagram including their personal details (name, surname, delivery address and contact telephone number).

In the event that there is no response from the prize-winner within the period indicated, he/she will lose the possibility of claiming the prize, passing the right to a substitute appointed by the procedure described in these rules.


ELEVENTH – TRANSFER OF IMAGE RIGHTS AND DATA PROTECTION

By participating in the prize draw, participants accept that the comments that will be published on Instagram may be shared with other users.

The winner of the prize draw expressly authorises the organising company to reproduce and use his/her name and surname, as well as his/her image, in any promotional activity related to the prize draw in which he/she has won without such use conferring any right of remuneration or benefit whatsoever, with the exception of the delivery of the prize won.

If the winner of the prize draw does not authorise the organiser, he/she must renounce the prize in writing and the prize will be awarded to a new participant following the same system as above.
